The Garrett County Chamber of Commerce presents the annual Fire on the Mountain Fireworks Display, sponsored by NLP of Maryland, LLC. Fireworks launched from the top of Bear Claw Tubing Park at Wisp Resort out toward the waters of Deep Creek Lake. Viewing spots include the scenic overlook on Rt. 219, McHenry Cove on Deep Creek Lake and businesses in McHenry.

Boat Parade on Deep Creek lake

Event Description:
The Evening Lighted Boat Parade will be held on Saturday, July 6th, starting from the Boardwalk and ending at Dutch’s at Silver Tree. The flotilla of boats will get underway shortly after dusk (if there are many antique and non-lighted boats, they will leave before dusk) and proceed in single file past a number of judging stations along the route. As the Parade is taking place at night, entrants are encouraged to illuminate their boats with the best lighting show they can produce. Spectators at the judging stations will vote for their favorite boats, and prizes will be awarded in a number of categories, with a Grand Prize consisting of a custom-designed Winner’s Pennant and trophy. Entrants in the parade will need to pay a $50 registration fee at the Grand Marshal’s boat anchored off the Boardwalk, and the number of entries are limited, so be sure to pre-register to ensure your spot.

Summer Art Camp

Event Description:
Students  will experience fine art in the studio and outdoors during Summer Art School camps.
Each project incorporates a fine artist, art concept, or technique. Students will use various types of paint, pastels, india ink, charcoal, clay, aluminum, wire, glass, printing ink, and much more to create one of a kind projects.Each camp week will focus on a new topic. Each week will include at least two new masters and projects in both 2-D and 3-D.

At the end of the summer, campers will get to exprerience another facet of the fine arts with an art show featuring their work.

Camps will be held at J.F.Mazur Fine Art Studio in Oakland, MD throughout the week, with the exception of Wednesdays.

On Wednesdays camp will meet in the Pocket Park for Plein Air days, weather permitting.

Deep Creek marina owner ordered to cease operations

OAKLAND — The owner of Lakeside Creamery at Deep Creek Lake has been ordered to cease operations of a mini-marina located on his property until a zoning issue is decided in Circuit Court.

During a hearing in June in Garrett County Circuit Court, Judge Jim Sherbin found that a zoning amendment that allowed Bill Meagher to run the mini-marina was of no legal effect and ordered that the decision by the county’s Board of Zoning Appeals to issue Meagher a permit be reversed.

The court issued the cease and desist order on June 26.

St. Moritz Properties LLC, Bill’s Marine Service Inc. and Silver Tree Marine LLC filed recently filed a motion to amend the order that was issued by Sherbin in June to add the following sentence at the end, “it is further ordered that Meagher/ Lakeside shall immediately cease and desist from operating the boat rental business on the property located at 20282 Garrett Highway in that it is enjoined by this order from doing so.”

Meagher rents personal watercrafts and pontoon boats.

The order was amended to make it clear that Meagher shouldn’t be operating without a permit, according to Greg Skidmore of Skidmore, Alderson and Duncan of Oakland, who is representing local marinas. Meagher has until July 3 to respond to the order that he cease and desists operations.

Meagher has operated the mini-marina for over a year on an invalid permit and even after the decision was made in June continued to operate, according to Skidmore.

“Even after the order, Meagher/Lakeside continue to defiantly operate the boat rental business without a permit and is clear violation of the Zoning ordinance and should not be permitted to do so,” Skidmore said in legal documents

On June 5, 2012, the county commissioners voted to make amendments to the Deep Creek Watershed Zoning ordinance to allow Meagher to have a marina that doesn’t offer the services associated with it.

A boat rental permit was issued by the Board of Zoning Appeals on June 11, 2012, to Meagher. St. Moritz Properties LLC, Bill’s Marine Service Inc. and Silver Tree Marine LLC appealed the issuance of the permit. The Board of Zoning Appeals denied the appeal and upheld the issuance of the permit.

Man fled boat by smashing window

DEEP CREEK LAKE — A Maryland Department of Natural Resources boat operator had to knock out a window to escape from the 23-foot work vessel that capsized and went to the bottom of Deep Creek Lake on the afternoon of May 15, according to a Watercraft Accident Report filed by Natural Resources Police Cpl. Robert Mayles.

The docked vessel began taking on water through an open dive door and then capsized when the operator, accompanied by an attendant, attempted to quickly drive it to a shallow area.

Both men swam to safety and neither was injured.

In his report, Mayles said that Lake Management employees Maxwell N. Anthony, the operator, and Seth M. Metheny were docked at the Discovery Center for about 20 minutes at about 4 p.m. as they were updating their iPads via the center’s WiFi service.

“… During that time the strong winds were causing the waves to break over the side of the boat where the removable dive door is located,” Mayles wrote, describing the waves as being as high as 2 feet.

“After noticing the water filling the bilge, the bilge pump was activated but was unable to keep up with the amount of water coming through the dive door.”

Anthony told Mayles the decision was made to back away from the dock and try to get the boat on plane to allow the water to drain off.

“Noticing the boat listing to the port side and the engine sitting very low in the water, they decided to try and get as close to shore as possible,” Mayles wrote. “Mr. Metheny was attempting to replace the dive door when the vessel capsized.”

Mayles said that Metheny immediately swam free of the boat. That’s when Anthony knocked out a cabin window to escape. Anthony and Metheny were wearing personal flotation devices, according to the report.

The boat went down in Meadow Mountain Cove in about 12 feet of water. The following day, NRP divers and Lake Management personnel used air bags to float the boat and it was pulled to shore. Mayles’ report indicates the aluminum vessel sustained $2,000 in damage.

Besides the cabin window that Anthony dislodged, an engine cowling was broken and radio and other electronic equipment was damaged. The vessel, which is insured, was considered to be disabled, according to Mayles’ report. The report lists Anthony as a boat operator with more than 500 hours’ experience, though it cites inattention and inexperience of the operator as factors that contributed to the accident. No charges were filed.

Deep Creek Lake a Vacation Destination at Any Season

GARRETT COUNTY, MD – Deep Creek Lake is located in Western Maryland and is a vacation spot for people ranging from those who live in nearby metropolitan cities to all around the East Coast.

“We have Deep Creek Lake which is good with anything in the water like boating and kayaking and we also have a ski resort here in the winter time,” says Sarah Duck, Garrett County Chamber of Commerce.

You can go paddle boarding, tubing, or just soak up the sunshine on a boat.

“It’s a real short drive and it’s a beautiful area,” says Jack Carter from Wisp Resort. “It’s not as humid as the D.C. area and so in the summer time you can come out here and escape to the cooler climate.”

Court reverses Garrett County decision expanding boat-rental competition on Deep Creek Lake

CUMBERLAND, Md. — A Garrett County judge is throwing cold water on expanded boat rentals at Deep Creek Lake.

The Cumberland Times-News (http://bit.ly/17qZO3o ) reported in its Friday edition that the court voided a boat-rental permit the county issued last June to the owner of the Lakeside Creamery. The permit allowed the ice-cream shop to offer personal watercraft and pontoon boat rentals despite its lack of other marina services such as fueling and boat repairs.

 Two marina operators challenged the permit. They alleged the permitting process was flawed. They also said the increased boat traffic would reduce safety.

Circuit Judge James Sherbin ruled that the permit was improperly issued.

The county’s planning director says the ice-cream shop can appeal the decision.

"Mini Marina" Amendments Declared "Defective"; Permit Issued "In Error"

Circuit Court Judge Jim Sherbin has deemed that the Deep Creek Lake Watershed Zoning Ordinance “mini-marina” amendments are defective and that the issuance of a permit to Lakeside Creamery owner Bill Meagher was, consequently, an error. Sherbin made his declaratory judgment on Tuesday, following a lengthy civil case.

St. Moritz Properties LLC, Bill’s Marine Service Inc., and Silver Tree Marine LLC filed a case against the Garrett County Board of Zoning Appeals, GC commissioners, and Meagher last year. The plaintiffs asked the court for a ruling on the legality of the amendments and the permit issuance.

Meagher submitted a proposal in spring 2012 to the Planning Commission and county commissioners to add a new category of use in the zoning ordinance that would allow “boat rentals, including boat rides and boat tours, as a separate business and not offering any other services associated with the marina.”

The Planning Commission approved the amendment and passed its recommendation on to the commissioners, who held a public hearing on the issue on May 31, 2012.

Information about the category contained the following sentence from the ordinance’s Table of Dimensional Requirements: “The use would require a minimum land area of 10,000 square feet in any districts where it is permitted.” One section of the ordinance states that a minimum of 10,000 square feet is required for the “sale or rental of recreational vehicles.”

The commissioners voted on the amendment on June 5, 2012. Commissioners Bob Gatto and Gregan Crawford approved the proposal. Commissioner Jim Raley voted against it, citing reservations about “unanswered uncertainties.

After the zoning administrator granted a marina permit to Meahger, the plaintiffs filed an appeal with the Deep Creek Lake Watershed Zoning Board of Appeals. The board heard the case last fall.

The plaintiffs and their lawyers questioned the legality of the amendment and permit issuance. They indicated there were several problems with the new land use and said Meagher did not meet the land-size qualifications.

By a vote of three to one, the appeals board upheld the decision to grant Meagher a permit, which allowed him to move forward with his plans to rent personal water crafts and pontoon boats to customers this year.

The plaintiffs pursued their case in Circuit Court, with various hearings held over the course of several months.

“The decision of the Garrett County Board of Zoning Appeals in this matter is reversed,” Sherbin wrote in his order this week about the permit issuance.

He also indicated that “the court need not reach the issue of compliance with the minimum [land] area requirements.”
